These general conditions regulate the contractual relationships in recruiting products. Carethy E-commerce offers these products in the online store.

The following defined terms and conditions are only applicable to the contractual relationship between the user (see customer) of the website Carethy and the seller, the company's Carethy E-commerce, which owns the online store.

1. PURPOSE

1.1. The purpose of the terms and conditions is the delivery of the products offered in the online shop, for a fee.

1.2. By accessing the website, the customer is obliged to agree to these rules and conditions.


2. EFFECTIVE DATE

2.1. These conditions, together with the order, form the contract between Carethy and the customer for the delivery of the products. There are no other conditions.

2.2. Once the customer agrees to read the general conditions and accepted them, it is assumed that the customer agrees to this.


3. ORDER

3.1. To place an order, the customer must be at least 18 years old.

3.2. Once the customer clicked on the "place order" button, the form with the personal data, which can be found in the online shop (24 hours), must be filled completely.

3.3. When the customer orders we will send an order number.

3.4. When ordering, the customer agrees to the terms. We can provide an estimated accept or reject.

3.5. If we accept the order of the customer, we confirm that by sending an order confirmation. If the customer made the e-mail adress available in the personal information, we will send the order confirmation this way. If the order is not being accepted, we will try to contact the customer by e-mail or telephone.

3.6. We are doing the best we can to provide customers with sending the order confirmation and deliver the right products. Yet it may happen that we can´t supply every product, for example because we do not have them in stock. In such a case we keep the costumer informed and offer alternative products. If the costumer does not agree with our proposal, we will cancel the order and report that you will not have to pay fees for the products that we can´t deliver. In rare cases, the prices of the products in our online shop can be wrong or can have unjustified low prices. When this happens, and we already confirmed a customer´s order, we will contact directly to pass on the confirmation with the right prices. In the case the prices are much higher, the customer can still cancel the order and we will refund the amount that is paid.
In case some of the products ordered are out of stock and we do not receive replies to e-mail requests and calls alerting the customer, the company reserves the right to cancel the products concerned and send the rest of the order. In case of disagreement when receiving the order, return policies of Article 11 shall apply.

3.7. You can cancel your order within the first hour of purchasing if the parcel has not yet left our premises


4. DELIVERY OF YOUR PRODUCTS

4.1 We will supply the products according to the General Terms & Conditions, which are reported in the order information.


5. PRODUCT

5.1 We attach great importance to information, such as the characteristics and functions of products, given by the technical description or our partner companies or the pictures of the manufacturer. This all happens within the boundaries of technology and in accordance with the highest market standards.

5.2 Read carefully the products description before buy it. The shown image can differ from the end product. If you have a doubt contact us before purchasing the product. 


6. PRICE

6.1 The price of the products can be seen clearly on the website. The price and terms of the product may vary. At the time the costumer makes an order, these are the valid prices.

6.2. We reserve the right to charge the order on the date we receive the order.

6.3. The selling prices in our online store are as follows: If the customer lives in the European Union, all the prices are included with VAT. Except when the delivery is made in a tax-free zone, we take the total amount. The customer needs to indicate this under ´other comments or special requests?´.

6.4. The shipping costs are not included in the price of the product. The shipping costs are paid by the customer and will be added to the total price of the selected products. The customer will be informed about the additional costs for the confirmation of the order and the closure.

6.5 We reserve the right to modify our prices at any time. We require ourselves that the current prices on the website, you see at the time of order, apply.

7. AVAILABILITY

7.1. De customer should be aware that the orders will be send, depending on the availability of the stock. If one of the ordered items is not in stock , we will contact the customer (at the date of order) by sending an e-mail with the possible delivery time of the products. If the customer doesn´t want to wait, he can ask for a refund of the amount he paid for the products that can´t be delivered.

7.2 If one of the products of the order is not available, we are required to send the available products and the shipping cost for the remainder of the purchase to be determined. If possible we will try a product of equivalent quality and price to replace the products which are not in stock. If this proposal is declined, we will deposit the amount of the products that were not available.

 

8. PAYMENT OF PRODUCTS

8.1. For maximum safety of the payments due, Carethy has a partnership with Caixa Catalunya. When the customer sees the symbol of Caixa Catalunya, the client can assume that the payment is 100% protected.

8.2. If our security department suspects fraud or irregularities, Carethy has the right to cancel the transaction for security reasons.

8.3. Carethy offers customers three different methods of payment:

- Payment by credit / debit card: If the buyer prefers to pay by credit card, the customer´s order can only be recognized and be progressed when the payment is approved by the bank. The online credit card payment conducted by the “Secure Socket Layer”, will encrypted your credit card information during transmission. For safety Carethy will check all the orders that will get paid by credit card. We accept American Express, Maestro and all Visa and MasterCard, which are verified by Visa as a secure payment method. For each order whose amount is higher than verified by Carethy, we ask you to show you identification as a proof of residence to send by fax or e-mail.

- Payment by bank transfer: The customer has to make the final payment to the account that is given. After completing the purchase, the customer will receive an automatic e-mail with the bank details for the payment. Important: for the transfer, the reference number has to be given, which appears when the order is made. If the reference is not available, the order is invalid and we give the money back after 7 days.

- Payment by PayPal: PayPal allows it to pay directly, without that you have to give the account information. PayPal encrypts confidential data, by using the best technologies available on the market.

8.4. If the purchase by and an end user or a business is done, an invoice will be set. This invoice is the amount of VAT, if applicable and shipping

 

9. DELIVERY OF THE GOODS

9.1. We ship the products to the customer to the delivery address indicated in the data.

9.2. On the website, in the shopping cart, you see the final amount of money increased with the shipping costs.

9.3. When an article indicates “in stock”, the time between ordering and delivery of the transport company depends on 2 factors:

1. The delivery time (4-6 days) = payment confirmation + preparing the shipment after receiving the package by the employees of the transport company. The time depends on the availability of the products.

2. The delivery of the order is determined by the employees of the shipping company. The customer will be informed by the e-mail “your order has been shipped”. These times are in working days.

9.4. We deliver the goods once payment is properly implemented and monitored. They will be supplied depending on the selected shape:

· SEUR: road transport, delivery within 1-2 working days

9.5. With the above hours and days we mean working days and working hours, so that´s excluding Saturdays, Sundays and holidays. If for whatever reason, this period will be exceeded, Carethy will find an alternative solution.

9.6. The customer agrees that there is a representative in the declared place of residence in order to receive the package. If there is nobody at the first delivery attempt, then the delivery company will come back several times. If the package is still not delivered after these time, then it will be returned to us. The amount paid by the customer will be refunded, without shipping costs, and costs of return.

9.7  Import duties, taxes, and charges are not included in the item price or shipping cost. These charges are the buyer's responsibility.

Please check with your country's customs office to determine what these additional costs will be prior to buy.

10. PRODUCT WARRANTY

10.1. All products offered by Carethy have warranty. If one of the products is affected by a manufacturing fault, we promise, two years from delivery, to replace it with a new one or we pay the money back. In this case, all costs of the return and redelivery are for Carethy.

10.2. The customer must contact us if a product is missing and send an e-mail within 14 days, after knowledge of it, send it to us. In this way we ensure that the product will still be delivered. In case that the problem is not guaranteed, the customer will have to pay additional costs if there are any.

 

11. THE RETURN AND REPLACEMENT OF PRODUCTS

11.1. If the Customer is not satisfied with the product which have purchased from us, he can change or return the product within 14 days of delivery of the goods and get a refund of the product returned no longer than 30 days. The cost of return of package will always be a customer responsibility. 6.95 euro in Spain and 9.95 euro for countries outside Spain.

11.2. If the product arrives damaged, harmed or with any anomalies,  the customer is obligated to inform Miscota immediately upon receiving the product. Guidelines and advice will be given by Customer Service upon contacting them. See section 11.3 for more on this matter.

11.3. To be eligible for a refund or a replacement product,  the following guidelines have to be followed.

• Products must be returned in the original packaging and/or in the box they arrived in. If this is not possible, packaging of at least similar quality has to be used. The customer may not staple the product or the packaging, neither may they add any form of stickers.
• The product may not have been used in any way that could have decreased its value or caused the product any harm.
• Returned products must be accompanied by the delivery note along with the reason/s for the return written on paper. This is to make the return faster and the process easier to handle.

11.4. The condition of the returned product will be assessed once it has been returned to the warehouse. If the product does not comply with the standards and requirements set for a return or if the status differs to that stated by the customer, we may in our sole discretion refuse or lower the amount of money to be refunded.

11.5. After a successful return the customer will be contacted by the company to be informed of a refund via the same payment channel chosen and used by the customer. If the customer has requested a replacement product, they will be contacted to be informed of the procedures to follow.

13. OBLIGATIONS OF THE CUSTOMER AND MISCOTA

13.1. Carethy would like to provide its customers with the necessary information and the products that are offered. Carethy in the case of force majeure, the absence of a customer or unforeseen conditions by a person of the contract, and for the non-fulfillment of these conditions, is not responsible.

13.2. The customer agrees to the order form and filled in the fields correctly with help of the instructions. Carethy protects data in accordance with the law. The customer agrees to pay the price of the products, including sales tax and shipping.

13.3. We recommend saving a copy of the data made by the purchase of the product. Carethy is not responsible for loss of data, files or in general for damage not due to a backup failure.

13.4. Carethy is not responsible for the consequences arising from the improper use of our products.

 

14. COMMENTS

All reviews, written by customers, are controlled by the marketing team. If the rating is against the law, ethics or morality (abusive publicity, defamation, insults, remarks out of context..) are violated, Carethy has the right to reject or edit.

 

15. PRIVACY

15.1. The personal data of the customer, for us available, are essential for the transmission of orders an invoicing. In the absence of this information, the order will be canceled automatically. When registering on our site, the client agrees to provide us with the valid data. These data are for the service of Carethy and correct identification of de registered costumer, as well as sending information and advertising for different products and offers that Carethy offers on its website.

 

16. AUTHOR

16.1. All content in de Carethy Online Store (images, text, names, trade marks and videos) are property of Carethy. The doubling of the whole on the content in any form must have prior, and the explicit approval by Carethy.

 

17. LAW AND JURISDICTION

17.1. This agreement shall be governed in accordance with Spanish law and European law.

 

18. OFFERS AND COUPONS

18.1. If the offer is not otherwise provided, all actions and vouchers are valid for one month.

18.2. The voucher promotions are only valid on the price of the product and are only applicable once.

18.3. To take advantage of a discount coupon action must always be a minimum amount purchased. If there is no minimum amount indicated, it is €60.

18.4. Carethy has the right to exclude a person who abuses the action or wants to repeatedly use the action under different identities.

18.5 You can only use one coupon per purchase. Coupons are not cumulative.


19. PERIODIC PURCHASES

  1. Now in Carethy you can make programmed orders, which means that you only have to do it once and you will receive it according to the periodicity that you have requested. Additionally, you will always have the best active promotion on our website, so you will not need to enter the coupons.

  2. To make use of this service you only have to request, during the online purchase process, that an order be served to you with the frequency that you determine, within the margins that we offer to you.

  3. For change the content of the order: you can change or replace the contents in the basket of your periodic purchases without any penalty, considering that must there be a period of at least 7 days between the notification of the change and the expected date of receipt the products.

  4. Keep in consideration that the shipping costs of your periodic purchases may vary depending on the changes you make in your basket. In case of periodic purchases that result in an amount lower than necessary for the free shipping, the amount for the shipping costs that will be charged will be the corresponding to the standard, as explained in our general conditions.

  5. For cancellation of periodic purchases shipments: you can cancel your shipments without any penalty considering that must there be a period of at least 6 days before the date of receipt the order. 7 days before the date on which your periodic purchases should be sent, we will send you a reminder message with the option to cancel your order.

  6. You can also pause your periodic purchases by not receiving the products in desired period. This will not be charged amount of that order but will follow the process for the next order.

Shop online safely

Don't share your personal data

Biuky never will send you any kind of email or call asking for your passwords or accounts data, credit card codes. If someone contacts you with that intention, don't ask them and please send us back this information to Miscota immediately. So we will proceed about the incident.

Verify the Fake Emails (attempts of 'spoofing' o 'phishing')

  • Ignore every email that asks for personal data or that makes you click into another website different to Biuky. Moreover if the payment has to be outside Biuky website. That should be an attempt of phishing and you have to consider it fraudulent.
  • Biuky use the endings "@biuky.com" for the emails. If you receive another ending, you can be sure that it is a fake email.
  • Some emails which practice phishing contains links to sites that use the word "Biuky" in its URL, but it's a website absolutely different. To realize that before clicking, you can displace the mouse over the link and you will see the URL associated. Probably will be in a different format than the originals ones from Biuky.
  • If even checking that you click into the email that practice phishing and you land into a site that seems to be "your profile" or seems that you have to verify or modify your personal data. Just ignore it and consider them fraudulent.
Inform us about the attempts of 'phishing'
  • Send an email to [email protected] with the fake email. This action will help us to locale its origin.
Protect your Password:
  • Passwords distinguish between capital and regular letters, and it contains a minimum of six characters. If you add numbers or special characters, you will have a better password because will be more difficult to guess.
  • If you use a public computer (libraries, cybercafés...) remember to logout your session in Biuky as soon as you finish.

Affiliation Agreement with Biuky

This Agreement covers the contractual relationship between the Affiliate (from now on referred to as Affiliate or You) and Miscota E-Commerce S.L (henceforth referred to as Merchant or We). Biuky.co.uk and its various domains will all be referred to as the Site. 1. Acceptance of the Affiliation Program 1.1. To proceed with this agreement and to confirm Your acceptance, Miscota E-Commerce S.L requires you to submit all and for the Merchant to collect all the Affiliate billing informing along with the data identifying webmaster/ blogmaster. 1.2. This program is meant for web pages in English for English markets and for Site´s which interfaces are in English. 1.3. The Merchant reserves the right to reject any application for the program. Furthermore they have every right to cancel the contract if they believe that they have detected any misuse of their promotion programs or any connections with inappropriate content. 2. Integration of the store: 2.1. The Merchant will provide the Affiliate with the technical information, to a reasonable extent, that is necessary for the integration of the shop via an iFrame. 2.2. An affiliate has the right to promote the Store to every and all of their members via e-mails, by banners and other means. 3. Merchant´s Commitment: 3.1. The Merchant promises to provide artwork (banners, mailings, buttons, logos) to be used for promotions with the intent of increasing sales. 3.2. The Merchant handles all procedures from the placing of orders thru the payment process to the deliveries, from customer care to after sales services. 4. Billing Method: 4.1. Affiliate income depends on the sales generated by the Affiliate. The commission to be paid is 10% for the initial purchases of any new users (percentage is of the value of the products, excluding shipping, coupons and taxes) for monthly invoicing of less than 10,000 €. Should the sums exceed the latter, refer to special plans. 4.2. If the customer requests a refund, the value of the commission will be deducted from pending invoices. 4.3. The Affiliate may claim his earnings to receive them on his Paypal account at any point of time when the total value of the Affiliate´s unclaimed commission exceeds 100€. 5.Contact Us 5.1. Area "Published with us" are a source of income/fringe benefits for selected affiliates. To qualify for those benefits, the Affiliate must complete the specific form in the sector and meet the requirements. If so, the Merchant will validate the Affiliate for the extra benefits. 5.2. The Affiliate waives any right of ownership on any content of the Merchant and may not take or use any of the Merchant´s property for his personal (or commercial) use unless otherwise agreed to. 5.3. For every "post" validated, the Affiliate will receive a "star" valued at € 2 per piece. The € earned in this manner will be added in the billing area. 5.4. The maximum number of rewarded posts per month is 8. 5.5. For a post to be valid, it must contain at least 350 words of quality content, provide resources and links (product URL in the Site) along with pictures of the related product. There are two goals for the posts. First is to be informative and second is to increase sales. 5.6 The Affiliate is responsible to guarantee that the written content is unique and has not been copied nor duplicated. Otherwise the Merchant has the right to remove the Affiliate from the affiliate program. 6. Discussion concerning our products: 6.1 The area “Comment on Our Products” is another potential source of income/ fringe benefit for affiliates. To qualify for these rewards, the Affiliate must comment on the Site’s products and have it validated by the Merchant. 6.2 For every comment that meets the requirements and has been validated, the Affiliate will receive a “star” valued at 0,25 € each. The € earned by this method may be added in the billing section. 6.3 The monthly limit of rewarded comments is 40. 6.4 For a comment to be qualified and accepted, it must contain at least 30 words, be creative and add value to the product while being truthful. 6.5. The Affiliate is obligated to write unique comments and not copy any content. Otherwise the Merchant has the right to cancel the partnership with the Affiliate. 6.6 The stars collected in publishing the content and earned from product reviews are cumulative. 7. White Label Store: 7.1 Affiliates can request the creation of a white label store on their blogs/sites/affiliation platforms 7.2 The Merchant assesses and decides whether it is possible to set up the white label store and reserves the right to refuse the proposals for any reason. 7.3 If the offer is accepted, the Merchant will integrate an online store with the Affiliate’s site, respecting its style and design if asked to. However the checkout process will always take place in the Site. 7.4 The white label store billing follows the same procedures as mentioned in part 4 of this Agreement. 8. Affiliate’s Responsibilities. 8.1. To ensure the proper use and implementation of the planned membership and to follow an accepted style, methodology of promotions. 8.2. The Affiliate will not deal with any complaints from third parties concerning their partnership with Miscota and its implementations, without receiving the right to do so from the Merchant. 8.3 The Affiliate will not use the trademark or property of the Merchant to generate traffic and exposure to its own webpage. That includes using the Site’s identity solely in their favour. Furthemore, it’s not allowed to use the same content and bids in PPC marketing campaigns on platforms such as Google Adwords. 9. Contract. 9.1 The terms of the contract are written down in this Agreement. However in any case the Merchant retains the right to cancel or modify the agreement at any time with a notice informing the Merchant affected of the change 10 days in advance. 9.2 The contract period is 6 months. Once the time is due, the contract renews automatically for another 6 months perios. 9.3 The Affiliate has the right to cancel, with 30 days notice, this contract, 10. Warranties and Guarantees 10.1 The Merchant is advised to resolve all incidents and make proper technical and operational management for all parties involved in the business. This includes the operations of the Affiliates what concerns the procedures mentioned in this Agreement. 10.2. The Affiliate is not required to cover costs or damage caused by the Merchant’s failure to provide. Earning generated by this Affiliate Program can only be monetized in cash via Paypal only or via coupons.
